Former Queensland CFMEU President David Hanna is facing court action for breaching right-of-entry laws and getting into an altercation with site managers at a Fortitude Valley construction site.

Fair Work Building and Construction alleges that Mr Hanna entered the site saying he wanted to hold discussions with workers, but he failed to give the appropriate entry notices to the employer.

FWBC alleges that when site managers asked Mr Hanna to provide his right-of-entry permits he raised his middle finger and said he did not need permits.

It is alleged that Mr Hanna’s unlawful entry escalated until he sprayed water over one of the site managers.

When the site manager attempted to to record Mr Hanna’s behavior on his mobile phone Hanna is alleged to have said: “Take that phone away or I’ll fucking bury it down your throat”.

FWBC Director Nigel Hadgkiss said the rule of law must be followed on construction sites.

“Senior union officials ought to be well-aware of the laws that apply when entering construction sites,” Mr Hadgkiss said.

“It is totally unacceptable for anyone to be threatened or remonstrated with for simply expecting officials to comply with the Fair Work Act.”

A first mention date has been set for 7 March 2016

It is alleged that the conduct occurred on 10 February 2015 at the “Broadway on Ann” construction site in Fortitude Valley.

Individuals who are found to have contravened s. 500 of the Fair Work Act (2009) may be fined up to $10,800 and organisations can face penalties of up to $54,000.
