The disgraced former Labor powerbroker is the first former MP to be prosecuted over last year’s inquiry.
Mr Macdonald’s former union mate and then chair of Doyles Creek Mining, John Maitland, has also been served a court notice.
He is being prosecuted for two counts of being an accessory before the fact to misconduct in public office in relation to aiding, abetting, counselling and procuring the commission of the two offences by Mr Macdonald.
Mr Maitland is also being prosecuted for giving false and misleading evidence before the ICAC.
His case is also listed for December 18 in Sydney.
Mr Macdonald, the man nicknamed `Sir Lunchalot’, was found to be corrupt by the ICAC in August last year over his handling of the Doyles Creek licence.
